eSignature Legality in Sri Lanka

Electronic Signature has been recognized by law in Sri Lanka since 2006,
with the passage of the Electronic Transactions Act.

Under Sri Lankan law, a written signature isn't always necessary for a contract to be valid. Contracts can be valid even if the involved parties agree verbally, electronically, or through physical documents, as per the law of contracts and the Electronic Transactions Act No. 19 of 2006, modified by the Electronic Transactions (Amendment) Act, No. 25 of 2017 (collectively referred to as the "ETA"), unless specific legal requirements dictate otherwise. The ETA confirms that contracts made electronically cannot be deemed unenforceable solely due to their electronic nature. In court, parties might need to offer evidence to establish a valid contract. Advanced digital transaction management solutions can provide electronic records that qualify as admissible evidence under Section 21 of the ETA. This evidence can substantiate the existence, legitimacy, and proper acceptance of a contract.
